Privacy Agreement - Introduction
ServerHub Inc. (“ServerHub”) is a Global Infrastructure as a Service (IaaS) Enterprise IT hosting provider. We own and operate Datacenter Networks on a global scale. ServerHub® takes the security of your data and our infrastructure very seriously. We are committed to providing our stakeholders with an environment that is safe, secure, and available to all of our customers around the world. By accessing our or using any of the Services, you agree to be bound by our User Agreement, Terms of Service as well as our Privacy Policy, GDPR addendum and Data Processing Agreement (DPA). Because the User Agreements contains legal obligations, please read them carefully. This Privacy Policy describes how ServerHub, Inc and its affiliates ("ServerHub," "we," "our" or "us") collect, use, and share information in connection with your use of our websites (including www.serverhub.com), services, and applications (collectively, the "Services"). This Privacy Policy (the "Privacy Policy") does not apply to information our customers may process when using our Services.
Section 1. Our Commitment to Your Privacy
Your privacy is important to us. To better protect your privacy we provide this notice explaining our online practices and the choices you can make about the way your information is collected by us and used.
ServerHub® reserves the right to make amendments to this agreement from time to time. Such changes, modifications, additions or deletions shall be effective immediately upon posting on-line at this location. You acknowledge and agree that it is your responsibility to review this site and this Policy periodically and to be aware of any modifications. You may identify ServerHub® Inc has revised this Privacy Policy by noting the "Effective Date" above. Your continued use of the site after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by the modified Policy. If you do not agree to these terms, please do not access or use this site.
Section 2. Information we collect and the way we use your Information
(a) Information You Provide to ServerHub
Registration of Account. When you register for an account with ServerHub, we may ask for your contact information, including items such as name, company name, address, email address, and telephone number. If you choose to refer a friend to our Services, we may also collect your friend’s email address so that we may send them a referral or promotional code to sign up for our services with us.
Payment Information. When you add your financial account information to your Account, that information is directed to our third-party payment processors.
Communications. If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide. We may also receive a confirmation when you open an email from us.
Personal information that you are asked to provide to us, in addition to reasons why you are asked to provide it, will be clarified at the point we ask you to provide such information
(b) Third Party Information we may receive
Third Party Partners. We may receive information about you that is publicly available from our third-party partners and combine it with data we already have about you.
(c) Cookies and Other Technologies used for tracking
- We gather information automatically and store it in log files. In addition, when you use our services, we may collect certain information automatically. This information may include: Internet Protocol Addresses (IP), browser types, Internet Service Provider Information (ISP), operating system, date/time stamps, referring pages etc.
To collect this information, a cookie may be set on your device when you visit our services. We may track your use across our different websites and services and in some countries, including countries in the European Economic Area (“EEA”), the information referenced above in this paragraph may be considered personal information under applicable data protection laws.
Section 3 . How we use information
We use the information we collect for the following purposes.
(a) Provide and Maintain Services
- Using the information we collect, we are able to deliver services to you and honor our User Agreement and Terms of Service contract with you.
(b) Communicate with you
- We use your information when needed to send you service notifications and respond to you when you contact us for assistance. We also use your information to inform you on new products or features that you’ve told us your interested in. You can opt out of marketing communications at any time by clicking the “Unsubscribe” link in the email that has been sent to you.
(c) Prevent Fraud and Promote Security
- We use the information we collect to prevent fraud, verify the identity of our users, and comply with all Federal, State and Local Laws. We authenticate our users so that we may facilitate security payments, protect against abuse and fraud and to respond to legal requests or claims as well as enforce our User Agreement.
(d) Data Subject to provisions of the General Data Protection Regulation (GDPR)
- For personal data subject to the GDPR, we rely on several legal bases to process the data. These include when you have given your consent, which you may withdraw at anytime by notifying us directly, and other tools; when the processing is required to perform a contract with you, like our User Agreement; and our legitimate business interests, such as improving and developing our services, and marketing new products that you have expressed interest in.
Section 4. How we share your information
We may share the information collected in various ways, including the following:
(a) Vendor and Service Providers.- We may share information with our vendors and other service providers that provide services on our behalf such as helping to provide our services, for promotional and/or marketing purposes, announcements, updates etc.

(c) Business Transfers. - We may disclose information and otherwise transfer to any potential acquirer, successor or assignee as part of a merger, acquisition, debt financing or sale of assets in which information is transferred to one or more parties as one of our business assets.
(d) Advertisements. - We work with third party vendors such as AdRoll, Google, Bing, Facebook and other network advertisers to show you ads that may interest you.
(e) Information Shared through Referrals. - If you sign up through a friend, we may share information with the referrer to let them know that you used their referral to sign up for our services.
(f) As required by law. - We may share information to satisfy applicable law, regulation, legal process or governmental request; enforce our policies, terms of service, user agreement, including but not limited to investigations of potential violations of policies.
This includes exchanging information with other companies, organizations of entities for the purpose of fraud protection and prevention.
(g) With your consent. - We may share information with your consent
Section 5. Our commitment to Data Security
Your information is stored on our servers. We treat data as an asset that must be protected and use tools to protect your personal information against unauthorized access and disclosure. However, third parties may unlawfully intercept data and access transmissions or private communications, and others may abuse or misuse the information we collect. Therefore, although we work hard to protect your privacy, we do not promise, and you should not expect that your personal information or private communications will also remain private.
Section 6. Verification of information submitted to us
By purchasing our services, you agree to comply with our False or missing contact information policy and provide and maintain accurate, complete and updated information. After you have ordered our services, we may be in communication with you about your account. These communications are essential to our relationship with you and to our ability to provide you with quality services that are responsive to your needs. As a result, we may maintain information about our communications with you for future use.
Section 7. Data Retention
We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, accounting records, legal requirements).
When we have no ongoing legitimate business need to process your information, we will either delete or anonymize it, or if this is not possible, then we will securely store your data from further processing until deletion is possible.
Section 8. Your Data Protection Rights under the GDPR
If you are a resident of the EU/EEA, you have the following data protection rights:

(d) If we have collected and processed your personal information with your consent, you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Section 9. International Data Transfers
ServerHub is a global business. We may transfer personal information to countries other than the country in which the data was originally collected. These countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer your personal information to other countries, we will protect that information as described in this Privacy Policy.
Section 10. Our Commitment to Children's Privacy
Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our website from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.
Section 11. Access to your Personal Information, Right to be Forgotten (For EU/EEA Residents)
You always have access to the information we have about you. To review and update your personal contact information, simply log into our client portal.
For residents of the EU/EEA, under the GDPR you have the right to erasure with undue delay (“Right to be Forgotten”), all requests for erasure can be submitted to [email protected]. Please note; a minimum processing fee of €15 will apply to each request and is subject to change depending on the complexity of the request.
Section 12. Account Protection
Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify ServerHub® and change your password.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement in accordance with the Notices Section. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement.
We may amend this Agreement at any time by posting the amended terms on the Site. Except as stated elsewhere, all amended terms shall automatically be effective 30 days after they are initially posted on the Site. Additionally, we will notify you through the Site's message center tools. This Agreement may not be otherwise amended except in a writing signed by you and us. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
